France sued over ELV law implementation

The European Commission has brought an action against France in the European Court of Justice for failing to correctly transpose seven provisions of the EU's 2000 end-of-life directive into national law.

For example, the commission alleges France failed to comply with a December 2004 deadline for banning certain hazardous materials such as mercury and cadmium from vehicles put on the EU market after 1 July 2003.

The commission says French law should not allow certain authorised demolishers to refuse end-of-life vehicles, which would result in a cost for the last holder of the vehicle and violate the directive. France is also accused of incorrectly delivering certificates of destruction.
